Unauthorised use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any licence to intellectual property rights, whether by estoppel, implication or otherwise. Should you not abide by any of the Terms and Conditions herein we may terminate your use of the Website without further notice.

You agree not to:

11. Contract

When you purchase a product or service from Familyrelatives.com we will send you via e-mail a confirmation acceptance and receipt of your purchase containing the details of your purchase. You will also be able to print your purchase Invoice from your account area on the Website. Your purchase invoice represents an offer to us to purchase a service which is accepted by us when we send our e-mail acceptance and confirmation to you. Any order that does not receive an acceptance and confirmation e-mail will be considered not to have taken place and will not form part of this contract. This contract and all orders accepted shall be deemed to have been formed in Jersey.

12. Refunds

Should you wish to cancel an order you are able to do so within fourteen days after the day of your purchase, which is the day in which the contract is entered into for paid services (Cooling-Off Period). Provided that you have not used any part of the subscription services for which you have paid. If you wish to cancel your order you should contact us using the 'contact us' facility on the Website.

We will be unable to offer a refund in those cases where you purchase a subscription service and have begun to use your subscription service prior to cancellation. We will not be able to refund you for unexpired subscription services or unused sets of units.

13. Electronic communications

The Internet is a global environment, using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis therefore when you visit Familyrelatives.com or send e-mails to us, or you communicate with us electronically, we in turn, will communicate with you by email or by posting notices on this Website. All charges must be paid for before accessing the information using your own credit card.

18. Addition of Data

Familyrelatives.com adds new data on a continuous basis as it becomes available.

Familyrelatives.com may decide at its sole discretion to charge a supplementary fee when new data is added to the Website. Suitable notice will be given to subscribers before such action is taken, thereafter new data may not be immediately available to existing subscribers where such an increase has become effective. The subscriber has the option to retain their existing subscription at the same rate until it expires or choose to upgrade by paying a supplementary fee.

19. Prices

While we make every effort to ensure that all prices on this Website are accurate, errors may occur. If we discover an error we shall inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel, and you have already paid for the goods or services, you will receive a full refund.

21. User content

You are solely responsible for the images, photos, graphics, profiles, messages, comments, notes, text, information, and other material content that you upload, submit, publish or display on the Website, or submit, transmit to or share with other users. You may not post, submit, transmit, or share user material on the Website that you did not create or that you do not have permission to post.

You understand and agree that Familyrelatives.com may, but is not obliged to, review the material and may delete or remove in its sole discretion (without notice) any Website content or material, for any reason or no reason without explanation, including without limitation material content or user content submitted by you and/or to close any topic, at any time without notice to you.

In addition we reserve the right to delete or remove in the sole judgment of Familyrelatives.com violates the Terms & Conditions, Rules & Guidelines and Links to other Website guidelines, or the Code of Conduct, or which might be offensive, illegal, financial in nature, advertising, or not related to genealogy or that might violate the rights, harm, or threaten the safety of users or others.

You are solely responsible at your own cost and expense for creating backup copies and replacing any user material content you post or store on the Website or provide to Familyrelatives.com

When you submit, post, share user material content to the Website, you authorise and direct us to make such copies thereof as we deem necessary in order to facilitate the posting, hosting and storage of the user material content on the Website. By posting user material content to any part of the Website, you automatically grant, and you represent and warrant that you have the right to grant, to Familyrelatives.com an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence with the right to sub-licence to use, copy, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such user material content for any purpose on or in connection with the Website or the promotion thereof, to prepare derivative works of, or incorporate into other works, such user material content, and to grant and authorise sub-licences of the foregoing. This may for example mean ceasing to provide Records from a particular data set at any time. Familyrelatives shall not be liable to anyone for withdrawing any Records from the Website or for refusing to accept an order.

We will not be liable for any loss or damage, whether direct, indirect or consequential loss of damage of any kind . By using the Familyrelatives Website you agree that Familyrelatives’ liability is limited to the fullest extent allowed by law. If you are dissatisfied with any portion of the Services on Familyrelatives or with any aspect or statement in these Terms and Conditions your sole remedy is to stop using the Services on Familyrelatives, if you are using any of our subscription Services, cancel your subscription. Familyrelatives’ total liability in any matter related to the Services on the Website or these Terms is limited to the amount you paid to Familyrelatives during the 12-month period preceding the event giving rise to the liability.

24. Force Majeure

Familyrelatives shall not be obligated to perform our obligations under these Terms to the extent that we are prevented, hindered, or delayed in the event of 'Force Majeure' meaning an event beyond the control of the Authority and the Operator, which prevents a Party from complying with any of its obligations under this Contract, including but not limited to: acts of God such as fires, explosions, earthquakes, drought, tidal waves and floods; war; hostilities; invasion; act of foreign enemies; rebellion; revolution; insurrection; military or usurped power; civil war; contamination by radioactivity from any nuclear fuel; riots; commotion; strikes; failure of transport links; failure of telecoms links; unavailability of the internet or any utility; go-slows; lock outs or disorder, unless solely restricted to employees of the Website or of subcontractors; and acts or threats of terrorism.

26. Termination

Familyrelatives.com reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion and without warning. If we cancel an order, it will be without charge to you.

Should your account expire and you do not use the service for a period in excess of twenty four months your details may be removed from the system and you will be required to re-register.

27. Disputes and complaints, Dispute Resolution, Arbitration and Class Action Waiver

Familyrelatives works hard to keep our users satisfied. Should a dispute arise between you and Familyrelatives we aim to provide a cost-effective manner to rapidly resolve the dispute. Should you have any concerns or dispute about the Services Familyrelatives provides you agree to first try to resolve the dispute informally, constructively and in good faith by contacting us.

In the event a dispute arises between the parties it is hereby agreed that the dispute shall be referred to Arbitration in Jersey, Channel Island in accordance with Jersey Arbitration and Mediation Rules.

28. General

You may not assign, sub-license, or otherwise transfer any of your rights under these Terms. We may assign these Terms or any rights hereunder without your consent or notice.

These Terms supersede any previous versions.

These Terms shall be governed by Jersey law, and you agree that any dispute between us regarding them or the Website will only be dealt with by the Jersey courts, Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.

29. Companies wishing to use the Website

If you are a company or organisation within the European Union wishing to use the Familyrelatives.com you must contact us as the Terms and Conditions are different. You may not use the automatic registration system.
